Attorneys regularly prepare advance healthcare directives for their clients. However, attorneys, lacking medical knowledge, are often considered ill-equipped to prepare such documents. While recognizing and respecting the fact that advance healthcare directives pertain to decisions about medical care, this article proposes that attorneys who prepare advance healthcare directives nevertheless provide a valuable service.

An ideal vision model accounts for behavior and neurophysiology in both naturalistic conditions and designed lab experiments. Unlike psychological theories, artificial neural networks (ANNs) actually perform visual tasks and generate testable predictions for arbitrary inputs. These advantages enable ANNs to engage the entire spectrum of the evidence. Failures of particular models drive progress in a vibrant ANN research program of human vision.

Providing in-utero treatments to target specific conditions in the fetus is a relatively new approach in perinatal care, with the vast majority of these treatments being used off-label. The high degree of off-label medication use in the perinatal and neonatal settings raises concern for the safety of both the fetuses and expectant mothers. This report presents two examples of intra-amniotic drug administration based on reported clinical cases. From the ethical framework of medical principlism, we examine the competing ethical duties of (...) autonomy, beneficence, and non-maleficence in this setting. We then lay out three fundamental ethical principles for obtaining informed consent and maximizing clinical benefit. (shrink)

Previous study has asserted that education majors score lower on assessments of moral development than do other majors. However, important factors associated with moral development have been overlooked. This study investigated the degree to which moral developmental differences exist by accounting for some of the oversights observed in previous study. Samples of 51, 38, and 62 college students in education, psychology, and other majors were addressed in terms of their moral judgment development, moral sensitivity, nonprejudice, and attitudes about human rights (...) and civil liberties. Although some minor trends are seen in favor of psychology majors, results support that moral developmental differences are not as dire as previous study portends. The authors recommend efforts to account for the individual, academic, and extracurricular experiences associated with majors and universities so that continued understanding of the moral development and functioning of their students can occur. We make two major comments. First, negative reinforcement contingencies may generate some apparent “drug-like” aspects of money motivation, and the operant account, properly construed, is both a tool and drug theory. Second, according to Lea & Webley (L&W), one might expect that “near-money,” such as frequent-flyer miles, should have a stronger drug and a weaker tool aspect than regular money. Le culte grandiose de Kali, la Mère, son incomparable symbolisme, ses litanies et ses chants, embrasse l'âme de l'univers qu'il glorifie comme aucune conception religieuse ne le fit jamais. La terrifiante déesse sème la peste et les pires ravages sur ses pas, tout en accordant sa grâce et sa clémence à ses enfants assez hardis pour soulever l'horrible masque derrière lequel elle se cache la figure. Ceux-là retrouveront les traits radieux qui ont enchanté leur enfance. La sublime conception de Kali, (...) la Mère, découle d'une philosophie moniste qui s'écarte pourtant sensiblement de la philosophie Védanta de Shankara. Tous deux partent, il est vrai, de la même idée. Ils admettent l'un et l'autre une substance une, indivisible et éternelle, que les Védantins appellent Brahma et les adorateurs de Kali, la Mère, Siva. Mais il y a divergence quant aux manifestations. Pour Shankara il n'y a qu'illusion. Il tranche le lien qui rattache le phénomène à l'absolu. Il se demande qui a pu susciter l'apparence. Mais, l'absolu étant la vérité même, il n'a pu engendrer l'apparence pas plus que la lumière n'aurait pu engendrer l'obscurité. Qu'y avait-il donc de commun entre les Brahmas et Maya? A première vue il semble qu'il n'y a aucun rapport. Pour Shankara il n'était besoin d'aucune relation, puisque Maya n'existe pas en réalité et que le monde n'est que mirage. Le monde n'existe que pour l'esprit qui est lui-même sujet aux hallucinations. Adorer la Mère, c'est accepter l'univers dans ses aspects les plus terrifiants. Cette philosophie est diamétralement opposée au christianisme dans son culte du Dieu d'amour, du Père plein de miséricorde. Le christianisme enseigne que tout se fait pour notre bien, tandis que pour les adorateurs de Kali, l'univers est féroce et hostile à l'homme, qui avant tout doit se montrer supérieur aux événements. Mais Kali n'est pas seulement la destructrice. Si elle démolit inexorablement toutes les formes vitales qui ont fait leur temps et qui se détériorent, elle en crée au fur et à mesure des nouvelles. C'est dans cette conception de la Mère qu'il faut chercher tout d'abord le mystère de l'esprit indien. Dans son essence la plus intime la mère du monde est l'absolu, est Siva même. Comme telle elle représente la connaissance, l'entité et la joie absolues. Pour les adorateurs de Kali les mots Mantram Saham (je suis elle) renferment la clef de la vie et dissipent crainte et tristesse. (shrink)

Critics of synergism often complain that the view entails Pelagianism, and so, critics think, monergism looks like the only live option. Critics of monergism often claim that the view entails that the blame for human sin ultimately traces to God. Recently, several philosophers have attempted to chart a middle path by offering soteriological accounts which are monergistic but maintain the resistibility of God’s grace. In this paper, we present a challenge to such accounts of the resistibility of grace, (...) namely that they imply that human beings are praiseworthy for omitting to resist God’s grace. Even if such views escape Pelagianism as it is typically defined, they fail to avoid the worry at the heart of prominent criticisms of Pelagianism concerning the praise for a human being’s salvation. Une conception du monde qui prendrait l'homme pour centre et partirait de lui ne donnerait donc aucune garantie de probabilité. Pourtant elle est assez générale, accoutumés comme nous sommes à juger d'après les perceptions grossières des sens, qui trop souvent nous induisent en erreur. Selon les physiciens, la (...) formule mathématique réunissant les coördonnées du temps et de l'espace, serait la plus conforme à la représentation du monde matériel. Nous avançons ici l'hypothèse que le monde matériel répond effectivement à cette conception, et qu'il est donc un monde plongé dans un repos éternel, dans lequel nous voyageons, pour ainsi dire, avec notre temps. Grâce à cette hypothèse, la causalité, le miracle, la prévoyance de l'avenir, s'expliquent plausiblement. Manifestement le troisième principe, l'esprit, est à la fois en interaction avec la matière et indépendante d'elle (p.e. la télépathie). Cette action réciproque suppose une parenté partielle entre l'esprit et la matière. C'est pourquoi nous proposons une seconde hypothèse: l'esprit est une "facies" de la matière qui reste en dehors de la rigidité du monde considéré comme espace et temps. On a toujours considéré ces éléments spirituels comme étant des êtres spirituels, mais leur aspect anthropomorphique nous empêche de croire à leur existence réelle. Si nous identifions la partie spirituelle du corps humain avec l'homme spirituel, le problème du libre arbitre s'explique avec clarté. Seul le procès spirituel du libre arbitre est vraiment libre, mais la volonté ne peut réaliser aucun changement dans la substance purement matérielle. La conception d'une àme se logeant dans le corps matériel comme dans une maison, et qui par ses actions détermine sa demeure future ne s'accorde pas avec l'hypothèse du monde matériel-et-temporel-en-repos. Suivant nos conceptions humaines, nous avons imaginé des êtres spirituels animés d'une volonté libre. Mais alors il faut supposer une unité spirituelle supérieure, qui considère et qui décide. Or, cette conception étant anthropomorphique il est admissible qu'elle soit la véritable figuration du monde. La solution de ce problème pourrait être trouvée par une troisième hypothèse" selon laquelle il existerait un monde supérieur, dans lequel le monde-du-temps-et-de-l'espace fusionne avec un temps supérieur, auquel le nom de "temps spirituel" serait approprié. Seul, ce monde supérieur plongé dans un repos éternel peut nous expliquer d'une façon convaincante l'univers. Un monde d'une essence et d'une invariabilité éternelles, dans lequel le temps, capable d'agir pas des voies infiniment variées, introduit des événements innombrables, les processus spirituels étant effectués par le temps spirituel, les événements matériels par ce que nous sommes habitués à appeler "le temps". Aquinas’s doctrine that infused virtues accompany sanctifying grace raises many questions. We examine one: how do the infused virtues relate to the acquired virtues? More precisely, can the person with the infused virtues possess the acquired virtues? We argue for an answer consistent with and informed by Aquinas’s writings, although it goes beyond textual evidence, as any answer to this question must. There are two plausible, standard interpretations of Aquinas on this issue: the coexistence view and transformation view. After (...) explaining the views, we present plausible reasons for and against each view. The evidence suggests, we argue, that the acquired virtues are both present and absent in the Christian. We then survey Aquinas’s account of virtual presence. Finally, we argue that the case of the presence of acquired virtues in the Christian is a good candidate for virtual presence. (shrink)

Perhaps the question “What is philosophy?” can only be posed late in life, when old age has come, and with it the time to speak in concrete terms. It is a question one poses when one no longer has anything to ask for, but its consequences can be considerable. One was asking the question before, one never ceased asking it, but it was too artificial, too abstract; one expounded and dominated the question, more than being grabbed by it. There are (...) cases in which old age bestows not an eternal youth, but on the contrary a sovereign freedom, a pure necessity where one enjoys a moment of grace between life and death, and where all the parts of the machine combine to dispatch into the future a trait that traverses the ages: Turner, Monet, Matisse. The elderly Turner acquired or conquered the right to lead painting down a deserted path from which there was no return, and that was no longer distinguishable from a final question. In the same way, in philosophy, Kant’s Critique of Judgment is a work of old age, a wild work from which descendants will never cease to flow.We cannot lay claim to such a status. The time has simply come for us to ask what philosophy is. And we have never ceased to do this in the past, and we already had the response, which has not varied: philosophy is the art of forming, inventing, and fabricating concepts. But it was not only necessary for the response to take note of the question; it also had to determine a time, an occasion, the circumstances, the landscapes and personae, the conditions and unknowns of the question. One had to be able to pose the question “between friends” as a confidence or a trust, or else, faced with an enemy, as a challenge, and at the same time one had to reach that moment, between dog and wolf, when one mistrusts even the friend. In the Catholic understanding of grace perfecting nature, revelation must protect the truths reason might know when reason is in its healthy state, lest reason lose those truths if it lapses into an unhealthy state. For this reason, the supernatural is always part of the definition of the natural, and not just for Christians but for all human beings.

Contemporary health care often lacks generosity of spirit, even when treatment is most efficient. Too many patients are left unhappy with how they are treated, and too many medical professionals feel estranged from the calling that drew them to medicine. Arthur W. Henri de Lubac’s treatment of the relationship between nature and grace will be critiqued by Herman Bavinck’s ‘grace restores nature’ theme. In two significant addresses, Bavinck critiqued a Roman Catholic approach to nature and grace. De Lubac’s influence upon Roman Catholic thinking addressing nature and grace occurred post-Bavinck and has altered Catholic thinking on the subject. The student of Spinoza is faced by a peculiar difficulty. On opening the Ethics —Spinoza's chief work, completed for publication shortly before his death in 1674—he finds a system of metaphysics set forth in geometrical form, starting from definitions, axioms, and postulates, and advancing synthetically from first principles to a detailed interpretation of the universe. The difficulty lies not in the language— Spinoza's Latin is easy to construe, and there are translations—nor in the lack of literary graces; his style indeed (...) is singularly impressive in its austere dignity. It lies rather in this, that the method of exposition conveys a misleading suggestion of dogmatism and finality, and conceals almost all traces of the patient inquiries that issued in the finished structure. If once the principles of the system are admitted, the rest appears to follow by logical necessity. But by what processes of thought was Spinoza led to those principles? This is the problem that besets the reader: in order to understand the Ethics, he must penetrate behind the text of the propositions to their significance as answers to the questions that were stirring in Spinoza's mind. This contribution investigates the unbearable tension between the homiletical act of naming reality on the one hand, and neglecting this same reality on the other hand, thereby causing it to return to an ignored, unchallenged and degenerated state. The author focuses on tension fields that are generated when preachers embark on the activity of naming realities in their proximate contexts and how they position, withdraw or distance themselves in a certain way when problematic elements are opened up by the act (...) of naming. By means of a theological reflection on the renewal of the heart by God's act of grace in Christ, the author attempts to identify key markers for a homiletic theory that will be able to link the act of naming reality with the act of nurturing this named reality. The article consists of four chapters taken from a comprehensive study on Wagner.The first chapter discusses the character of the man Wagner. The author undertakes a social analysis which reveals Wagner to be a bourgeois figure who is no longer able to fulfill the monadological claims of bourgeois society, and who actually deserts to the ruling powers while seemingly in conflict with the society of his day. This analysis is made particularly clear through a study of Wagner's anti-Semitism.The following sections, (...) only excerpts of which appear in the present essay, study the relationship between Wagner’s social character and the technical structure of his works, using concepts such as the conductor- composer and the,,gestural type“ of composition. This approach involves minute analyses of certain essential elements of Wagner's technique : the leitmotif, the infinite („unendliche“) melody, his harmonization and scoring.From the principle of Wagner's instrumentation the author derives the concept of phantasmagoria, which is the subject of the sixth chapter of the larger wrork (reprinted here). Phantasmagoria is defined as the aesthetic phenomenon that tends to hide the mode of its genesis and to appear as „nature“.The seventh and eighth chapters have not been included. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. Não possuía os prazos. Vivi puxando difícil de dificel, peixe vivo no moquém: quem mói no asp’ro, não fantaseia. Mas, agora, feita a folga que me vem, e sem pequenos dessossegos, estou de range rede. E me inventei neste gosto, de especular idéia. O diabo existe e não existe? Dou o dito. Abrenúncio. Essas melancolias. O senhor vê: existe cachoeira; e pois? Olhe: um chamado Aleixo, residente a légua do Passo do Pubo, no da-Areia, era o homem de maiores ruindades calmas que já se viu. Me agradou que perto da casa dele tinha um açudinho, entre as palmeiras, com traíras, pra-almas de enormes, desenormes, ao real, que receberam fama; o Aleixo dava de comer a elas, em horas justas, elas se acostumaram a se assim das locas, para papar, semelhavam ser peixes ensinados. Um dia, só por graça rústica, ele matou um velhinho que por lá passou, desvalido rogando esmola. O senhor não duvide – tem gente, neste aborrecido mundo, que matam só para ver alguém fazer careta... Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Esse Aleixo era homem afamilhado, tinha filhos pequenos; aqueles eram o amor dele, todo, despropósito. E que eu merecia de ir para cursar latim, em Aula Régia – que também diziam. Tempo saudoso! Inda hoje, apreceio um bom livro, despaçado. Na fazenda O Limãozinho, de um meu amigo Vito Soziano, se assina desse almanaque grosso, de logogrifos e charadas e outras divididas matérias, todo ano vem. Em tanto, ponho primazia é na leitura proveitosa, vida de santo, virtudes e exemplos – missionário esperto engambelando os índios, ou São Francisco de Assis, Santo Antônio, São Geraldo... Eu gosto muito de moral. Raciocinar, exortar os outros para o bom caminho, aconselhar a justo. Minha mulher, que o senhor sabe, zela por mim: muito reza. Ela é uma abençoável. Compadre meu Quelemém sempre diz que eu posso aquietar meu temer de consciência, que sendo bem-assistido, terríveis bons-espíritos me protegem. Ipe! Com gosto... Como é de são efeito, ajudo com meu querer acreditar. Mas nem sempre posso. O senhor saiba: eu toda a minha vida pensei por mim, forro, sou nascido diferente. Eu sou é eu mesmo. Diverjo de todo o mundo... Eu quase que nada não sei. Mas desconfio de muita coisa. O senhor concedendo, eu digo: para pensar longe, sou cão mestre – o senhor solte em minha frente uma idéia ligeira, e eu rastreio essa por fundo de todos os matos, amém! Olhe: o que devia de haver, era de se reunirem-se os sábios, políticos, constituições gradas, fecharem o definitivo a noção – proclamar por uma vez, artes assembléias, que não tem diabo nenhum, não existe, não pode. Eu podia ser: padre sacerdote, se não chefe de jagunços; para outras coisas não fui parido. Mas minha velhice já principiou, errei de toda conta. E o reumatismo... Lá como quem diz: nas escorvas. Ahã. Hem? Hem? O que mais penso, testo e explico: todo-omundo é louco. O senhor, eu, nós, as pessoas todas. Por isso é que se carece principalmente de religião: para se desendoidecer, desdoidar. As one might expect of a book of this modest size which bears such a title, this work concentrates upon only one of the many topics subsumed under the rubric "supernatural." After some reflection, the impression develops that this focus is on a colloquy between scholastic and contemporary formulations of the personal relationship between God and man in the process of divinization by grace. Kenny seems to offer the theory of "created actuation by Uncreated Act" as a particularly valuable (...) model of explanation for this personal union. The genre of this work is too technical in its language to be described as popular and perhaps too brief and unnuanced to appeal to a technical audience. The mode under which Kenny approaches his problem is historical. Nonetheless, the author excuses himself from treating antecedent formulations, although he averts to the different way in which the question has been posed in Eastern Christianity. Kenny opens his own account with a brief precis of some "constants" in Catholic grace-doctrine. It is regrettable that William of St.-Thierry and Peter Lombard were not treated more extensively, for the formulation of deifying grace in terms of its "uncreatedness" received a new slant in their works. This slant can be illuminated considerably if one recalls that these theologians had at their disposal only an impoverished, "Platonizing" schema of causal explanation, plotted only on the axis of formal causality and its intentional-exemplar modes. Lacking such a preface in twelfth-century formulations, the author’s treatment of "high Scholastic" grace-doctrine largely from the perspective of Thomas’ and Bonaventure’s insistence on "created grace" seems to be rather abruptly introduced. However, this sense of abruptness disappears if one correctly grasps the thesis toward which Kenny’s argument is aimed. Chapter Four treats the fourteenth- and fifteenth-century nominalist formulations, with Ockham and Biel as examples. Kenny is highly critical of the subversion of the doctrine of grace as intrinsic divinization and as personal union which these theologians effected. Chapter Five is billed as a survey of the theme of supernatural union in post-Tridentine theology. Curiously, the bulk of the chapter is expended on an amicable presentation of the De la Taille-Rahner explanation of graced divinization in terms of quasi-formal causality. Crysdale new york: seabury books, 2016. 192 pp. $16.00Cynthia Crysdale aims to show how atonement can have meaning for modern and postmodern Christians who reject the idea that God wills Jesus's violent death. She starts with stories of people who were estranged from God but (...) have been given grace to love God anew. Their subsequent lives are not perfect and involve multiple deaths of the old self and resurrections into the new. Yet there is a reconciliation not present beforehand: not a change in God, who has always loved us, but a change in us. Crysdale seeks to navigate between two undesirable positions: a penal substitutionary doctrine of the atonement, which she thinks posits a violent God, or a rejection of the idea of atonement altogether. She sees atonement as not only moral influence showing an example but a relationship that involves our whole being.Crysdale then presents a historical overview to show that this understanding of atonement is a plausible interpretation of scripture and tradition. Biblical sacrifices were not intended to propitiate an angry deity but to expiate human sin. New Testament writers who saw Jesus's death on the cross in continuity with these sacrifices were not implying that God was punishing Jesus. Jesus's statements about giving his life as a ransom prophesied the subversion of patron–client power relations rather than predicting a transaction whereby Jesus would pay for sin. Subsequent writers who saw Jesus as gaining victory over the devil saw God and Jesus as united against the powers and Jesus as attaining justice by love. Even Anselm, sometimes blamed for the penal substitutionary view, intended to avoid the idea of the crucifixion as God's punishment of Jesus. In the honor code of the time, either satisfaction or punishment was required. Therefore, Jesus's act of making satisfaction is precisely not punishment. Crysdale sees subsequent conflations of satisfaction and punishment as distorting Anselm's original intent and implying that God requires violent punishment of sin. [End Page 208]Crysdale then takes readers on a tour of changes in scientific, historical, and epistemological consciousness in the modern era to ask how theology might be done today. Drawing on Bernard Lonergan, she describes multiple dimensions of conversion that are all instances of grace when they occur. She then interprets the incarnation as indicating God's offer of friendship with humanity and Jesus's death and resurrection as indicating the transformation of power and oppression. Believing that an abstract atonement over the heads of human beings does not exist, she concludes with further stories of lives transformed by an encounter with God, including Martin Luther King Jr. and Dorothy Day.This book is suitable for educated lay adults, advanced undergraduates, or introductory seminary courses. Protestant audiences may find it typically Catholic, even though Crysdale is an Anglican, because it emphasizes changed lives rather than God's act of justification prior to any change in us. Theologically, it does not deal with every possible objection to its thesis. Those concerned with cultures of impunity, where malevolent lawlessness gets its way, may think that rejecting any sense of punishment of sin in the crucifixion throws the baby out with the bathwater. Recently, Fleming Rutledge (in The Crucifixion), drawing on Karl Barth, has made a point of retaining punishment as one meaning of the atonement even while emphasizing that God's wrath is always in the service of God's love. Transformed Lives does not have the last word on the atonement and would not claim to, since Crysdale wants to invite readers to do theology befitting their changing context. However, readers at many levels will benefit from its accessible treatment of its topic and invitation to reflection that befits a loving, reconciling, evil-opposing God.Virginia W.
